1. Electronic Record and Signature Disclosure
From time to time, PayServices Bank ("we," "us," or "Bank") may be required by law to provide you with certain written notices, disclosures, agreements, and other communications. Described below are the terms and conditions for providing these communications to you electronically through the ITAM application or other electronic means, and for using electronic signatures to enter into agreements with us.
This Disclosure is provided in accordance with the federal Electronic Signatures in Global and National Commerce Act ("E-SIGN Act"), 15 U.S.C. § 7001 et seq., and similar state laws including the Idaho Uniform Electronic Transactions Act.
Please read this Disclosure carefully. By accepting it (typically by tapping "I agree" within the ITAM application or by continuing to use our Services after we make this Disclosure available), you consent to the use of electronic records and electronic signatures as described below.
2. Scope of your consent
By providing your consent, you agree:
- To receive in electronic form all notices, disclosures, agreements, statements, periodic statements, terms, fee schedules, privacy notices, error-resolution notices, change-in-terms notices, and other communications (together, "Communications") that we are required to provide to you by law or that we otherwise choose to provide to you;
- That your electronic signature on any agreement or document presented to you electronically has the same legal effect as a handwritten signature;
- That electronic records of your Communications and signatures will be admissible as evidence in any legal, administrative, or other proceeding to the same extent as paper records.
3. Paper copies and your right to non-electronic records
PayServices Bank is a digital-only institution and does not mail paper copies of Communications. The entire customer relationship — including account opening, ongoing servicing, and the delivery of Communications — is conducted electronically through the ITAM application. Maintaining the relationship in electronic form is a condition of using the Services, and your consent to this electronic-only model is captured at account opening.
How you exercise your right to a non-electronic copy. Federal law gives you the right to have records made available to you in a non-electronic form. We satisfy that right by ensuring that every Communication we provide to you is delivered in a format you can save, download, and print yourself, at any time, at no cost, from within the ITAM application. You may print any Communication on your own printer, save it as a PDF, or transmit it to a third-party printing service of your choice.
What we do not provide. We do not mail paper copies of Communications, and we do not maintain a paper-mail channel for delivery of disclosures, notices, statements, or agreements. Requests to mail paper copies cannot be fulfilled.
If you are unable to download or print a Communication for technical reasons, please contact us and we will work with you to provide the Communication in another electronic form (for example, by email attachment). Our contact details are in Section 8 below.
4. Withdrawing your consent
You may withdraw your consent to receive Communications electronically at any time by contacting us as described in the "How to contact us" section below. Because PayServices Bank is a digital-only institution and does not deliver Communications by paper mail, withdrawing your consent has the following consequences:
- You will no longer be able to use the ITAM application to receive Communications electronically or to sign agreements electronically;
- We will be unable to continue providing the Services to you, because the Services are operated entirely through electronic Communications;
- Accordingly, your account may be closed or your access to the Services terminated, in accordance with the Terms of Service. Closure of your account does not relieve you of obligations incurred before closure.
Withdrawing consent does not affect the legal effectiveness, validity, or enforceability of electronic Communications or signatures provided before the withdrawal. Before your account is closed, you remain able to download and save any Communication previously delivered to you.
5. Updating your contact information
You agree to keep us informed of any change to your email address, mobile telephone number, or other contact information by updating your profile in the ITAM application or by contacting us. You are responsible for ensuring that we have your current contact information so that we can deliver Communications to you.
6. Hardware and software requirements
To access and retain Communications electronically, you must have:
- A computer or mobile device with internet access;
- A current version of a web browser (such as Chrome, Safari, Firefox, or Edge) with cookies and JavaScript enabled, or a current version of the ITAM mobile application;
- A valid email address;
- Sufficient storage space to save Communications, or a printer to print them;
- A program that can read PDF files (such as Adobe Reader) for documents delivered as PDFs.
The minimum system requirements may change over time. We will notify you in advance of any material change that may affect your ability to access or retain Communications.
7. Acknowledging your access and consent
By accepting this Disclosure, you confirm that:
- You can access and read this Electronic Record and Signature Disclosure;
- You can print or save this Disclosure for your future reference and access;
- Your hardware and software meet the requirements described above;
- Until or unless you notify PayServices Bank otherwise, you consent to receive electronically all Communications that we are required or otherwise choose to provide to you in connection with your use of the Services.
